Changes to MLS Commission Delayed

August 17th, 2024

Changes stemming from the “Sellers” lawsuit against NAR has been delayed until August 17th, 2024 to give MLS’s across the Country time to facilitate the change. 

Additionally, aggregators aka Public Portals, such as Homes.com, Zillow and Realtor.com must also make changes because an earlier change required that the MLS must make the commission fields available to be posted on these sites. That is no longer permitted under the terms of the settlement agreement. 

In fact, Commission may NOT be posted on any MLS or any site that the MLS feeds; including Broker and Agent sites. One would think that transparency is best, but seems the Attorney’s and Judge think differently. 

Honestly, none of this makes sense. What simply could have and should have changed, is that every client, Buyer or Seller, must be presented with and sign a Disclosure which explains how Commission is offered, how its paid and that its all negotiable; if the Broker wishes to. Otherwise, find another Realtor. 

Instead, we have this drastic change that, at least in the short term, may hurt buyers as they try and figure out how to pay for the services of a Realtor.
